Live-in is not the same as marriage, it is adultery: High Court
The High Court has taken a tough stand on live-in relationships. The Punjab, Haryana High Court has refused to give protection to married live-in couples due to the fear of danger from their family members. The court has said that those who run away from their parents and live together, hurt the name and respect of their family, their society and their local level, this is inhuman.
India is adopting the western culture of live-in relationships, which is wrong. If it believes that the relationship between the petitioner is of the nature of marriage, then it will be injustice to the wife and child who have maintained that relationship with respect. Referring to the petitioner who is already married, the court has said that if it is that someone is already married, then we cannot provide him protection.
Marriage is a social and cultural bond which is the identity of Indian culture. The Hon’ble Court has said that under Article 21 of the Indian Constitution, every person has the right to live with peace and dignity, therefore by allowing such petitions, we are encouraging wrongdoers. We are somewhere promoting the practice of two marriages. Which is wrong, it is a crime, it violates the right of the other spouse and children to live with dignity
Live-in in india
💠Indian society is largely conservative, and live-in relationships can be seen as taboo. Couples often face judgment and disapproval from family, friends, and the broader community.
💠Families may pressure individuals to marry instead of living together without marriage, which can strain family relationships and create emotional stress.
💠While the Supreme Court of India has recognized live-in relationships, they do not have the same legal status as marriage. This can lead to complications in areas such as inheritance, property rights, and the ability to make medical decisions for one another.
💠In the event of separation, child custody can become complicated due to the lack of clear legal guidelines for live-in relationships.
💠Buying property jointly can be risky without the legal framework of marriage. In the case of a breakup, dividing assets can become contentious and legally complex.
💠Women in live-in relationships may face financial insecurity if the relationship ends, especially if they have been financially dependent on their partner.
