What is the law regarding covering the face during voting?
Recently, in the Lok Sabha elections held in Hyderabad, BJP candidate Madhavi Lata asked a person to remove her burqa, due to which a case was registered against Madhavi Lata after the intervention of the officer present there. What is the law regarding burqa? The Election Commission says that there is no such provision but the election officials have the right to match the identity card with the veil.
Generally it has been seen that women remove their veil or burqa. Keep in mind that there is no special provision in the Constitution and Election Commission regarding removal of burqa. Yes, if the number of women wearing burqa at an election booth is high then their identity card and face can be checked. Matching may be asked by the officers but it should also be ensured that it is done by a lady officer or employee of the face and identity card at a place where their privacy or liberty is not violated.
Although removing the burqa during elections is included in the work of the Election Commission to conduct fair elections, it cannot be called cultural or political. The job of the Election Commission is to ensure that the elections are fair.
